These Terms of Use / General Terms and Conditions ("Terms") govern your access to and use of the PolitPro app (the "App") and the websites politpro.eu and wahl-trends.de (the "Websites"; App and Websites collectively referred to as the "Services") provided by Manuel Gutsche · Postfach 1107 · 90523 Wendelstein (the "Operator", "we", "us", "our").
By downloading, accessing, or using the App, you agree to these Terms. Please read these Terms carefully. If you do not agree with the Terms, please do not use our Services. We may amend and/or update these Terms at any time and at our sole discretion. If we do so, we will notify you of these changes before you use our Services (e.g., by mentioning them in the App Store or Play Store when a new version is released).
By continuing to use the Services, you confirm your acceptance of the amended Terms of Use. If you do not agree to the amended Terms, we ask you to discontinue using our Services and, in particular, to delete the App.
PolitPro is a mobile communication and information platform focused on political topics. In combination with our websites, our Services include analyses powered by artificial intelligence, current election trends, information on Sunday question polls from leading opinion research institutes, as well as political news and discussions.
The operator is liable, regardless of the legal basis, for damages or reimbursement of futile expenses in full only for damages caused by willful misconduct or gross negligence, in the event of assuming express guarantees and assured properties, for damages resulting from injury to life, body, or health, for claims arising from product liability, and in cases of mandatory statutory provisions.
In the event of a breach of essential contractual obligations (cardinal obligations), the operator is liable – notwithstanding the preceding paragraph – limited to the typical damages reasonably foreseeable at the time of contract conclusion. Cardinal obligations are duties whose fulfillment is essential for the proper execution of the contract and on whose observance the contracting party may regularly rely.
To the extent that the operator's liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.
You agree to defend, indemnify, and hold harmless Politpro and/or the operator against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including, but not limited to, attorney's fees) arising from your culpable:

We may, at our sole discretion, improve, change, or temporarily or permanently discontinue the services and/or individual content.
You acknowledge that the operator cannot be held liable by you or any third party for any modification or discontinuation of the services or any part thereof.
We are entitled to assign, sublicense, or otherwise deal with our rights concerning the services and/or parts thereof, without notifying you or obtaining your consent.

These Terms of Use are exclusively governed by German law.
For all disputes between you and the operator concerning these Terms of Use, the exclusive jurisdiction of the courts of Germany is invoked.
Should individual provisions of these Terms of Use be or become invalid, or should gaps arise, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the corresponding German laws shall apply.
Ancillary agreements require written form. A waiver of the written form requirement must also be made in writing.

Downloading and using the App are free of charge. To finance the App, we reserve the right to introduce additional in-app purchases, advertising, or other paid services in the future. For in-app purchases, the terms and conditions of Google Play or the App Store apply.
To use our Service, an automatic account will be created. Persons under 16 years of age are excluded from using the Services. As the account holder, you are solely responsible for the activities carried out from your account.
After downloading the App, we will ask for your consent to communicate electronically via Push Services. If you agree to these, you will receive push notifications. These may be sent, for example, when new poll results have been published. We may also inform you via push notifications about other news related to the App.
You are free to deactivate these communications at any time by changing the notification settings on your device.
Our Services consist of interactive features that allow users to post contributions and transmit content, including, but not limited to, text and photos. As a user, you acknowledge that user content may be visible to anyone who has installed the App or to whom the content is made accessible via external features of the Services.
By sharing content in our App, the Operator receives a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, edit, translate, publish derivative works of such content, distribute it, and make it publicly available worldwide in any manner on or alongside the App. This also includes publication on our social media channels (e.g., Instagram, TikTok, ...).
By using our Services, you agree to comply with the conduct guidelines listed below, which may be updated from time to time. Among other things, the following is prohibited:

Should users become aware of or suspect any security vulnerabilities, they commit to informing the operator as quickly as possible via one of the provided contact methods and to refrain from making information about exploiting such vulnerabilities accessible to other users or third parties in any form.
You further agree to comply with the terms and conditions of third-party providers (including the iTunes App Store Terms of Service and/or the Google Play Store). You acknowledge that the availability of the services is dependent on the terms of these third-party providers. You agree that the usage rules for the application may also be subject to additional applicable restrictions. In the event of a conflict between the terms of third parties and these Terms of Use, the third-party terms shall take precedence.
By using the discussion features, you expressly agree to abide by the Community Guidelines. The Community Guidelines are accessible within the app. Contributions and access that violate these guidelines may be removed or blocked by the operator. The interpretation of the Community Guidelines rests solely with the operator.
The operator reserves the right to block a user's access to parts of or the entire service, regardless of whether they violate the aforementioned rules, and even without prior notice.
These Terms of Use govern the use of the app on smartphones and other electronic devices.
The operator grants you a limited, non-exclusive, non-transferable, and revocable license to use the app for personal and non-commercial purposes. You may generally only use the app on a device where such use is permitted by the applicable usage rules of the device manufacturer or third-party providers. These licensing terms also cover all updates to the app or services provided that replace and/or supplement the original app, unless such an update includes a separate, subordinate license.
However, your right to use (unless explicitly permitted by us) does not include the following:
Should you violate the foregoing, the operator may terminate your use of the services by blocking your device. This does not preclude the assertion of further rights, particularly claims for damages.
You acknowledge that you are solely responsible for your contributions and those created by your device.
The operator will not accept any disclaimer of responsibility from you regarding content, data, and/or information. Specifically, we do not guarantee that the published content is true, fulfills a specific purpose, or serves such a purpose.
Should you become aware of any unlawful use of the services, we kindly request that you report it immediately via the app or contact us through our support channels (via the app or the website).
The design of the app, along with its texts, scripts, graphics, interactive features, as well as the trademarks, marks, and logos, and all associated rights within the app and/or website, are protected by copyright and other proprietary rights under German and international laws and conventions. The operator provides the service to you "as is." The operator expressly reserves all rights not explicitly granted to you. You agree not to support any use, reproduction, or distribution of the contributions for commercial purposes, unless expressly permitted.
The services are provided to you on an "as available" basis, without any representation or warranty of any kind.

In the event of an app failure, users are requested to contact the party from whom the app was downloaded and, where possible, inform support via the available contact channels.
